Every parcel in Northwest Arkansas answers to a different stack of authorities — a city or the county, one of five electric providers, a municipal water system or a rural authority, sometimes a property owners association on top of all of it. These are the official sources for checking which ones apply to a specific address.

Soil depth and water table drive whether a lot will perc. A tract can be beautiful, road-fronted and completely unbuildable. Pull Web Soil Survey before you write an offer, and make septic feasibility a contingency, not an assumption.

Land touching Beaver Lake usually abuts a federal Corps take-line rather than the water itself. Private docks, clearing and structures near the shoreline are governed by the Corps, not the county. Confirm shoreline permit status in writing before a listing describes lake access.

Service territory in NWA is not drawn on city lines. Two houses on the same street can have different electric providers.

Electric territory in NWA was set decades before current city boundaries. Confirm the provider by service address with the utility directly — a listing that names the wrong provider is a correctable error before closing and an expensive one after.

Unincorporated Benton County has no zoning, but subdivision regulations, setbacks, easements, stormwater and floodplain rules still apply — and a city’s planning area can reach past its limits. Private subdivision covenants are separate again and the county will not enforce them.

Avoca, Little Flock, Springtown, Gateway and other small municipalities do not have an individual GIS viewer in the regional directory. Use the Benton County Basemap for parcels there, then call city hall directly for zoning and permits. Bethel Heights consolidated into Springdale in 2020 — records for that area now run through Springdale.
Washington County

Unpaid POA assessments attach to the lot and delinquent lots do go to judicial sale. Confirm assessment status, transfer fees and ACC approval requirements in writing during the option period. City rules and POA covenants are separate documents — a property can comply with one and violate the other.

An STR in NWA can require a city permit, compliance with private subdivision or POA covenants, and registration for state, county, city and A&P lodging taxes. A permissive city ordinance does not override a recorded covenant that bars short-term rental. Get the specific address cleared in writing on all three before anyone underwrites a purchase on STR income.
