01 · Acceptance of Terms
By accessing or using nwastats.com (the “Site”), submitting a form on the Site, or opting in to receive text messages from us, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, please do not use the Site or submit your information to us.
We may update these Terms from time to time; see Changes to These Terms below. Continued use of the Site after an update constitutes acceptance of the revised Terms.
02 · Who We Are
NWA Stats is a real estate information brand serving Benton, Washington, and Madison Counties, Arkansas. Real estate brokerage services referenced or offered through this Site are provided by Collier & Associates, a licensed Arkansas real estate brokerage, located at 2909 Glory Drive, Suite 201, Fayetteville, AR, phone 479.274.0662. References to “NWA Stats,” “we,” “us,” or “our” throughout these Terms refer to this brand as operated by Collier & Associates and its affiliated agents, unless context indicates otherwise.
03 · Eligibility & Acceptable Use
Eligibility
The Site is intended for users who are at least 18 years old and legally able to enter into agreements regarding real property in the United States. By using the Site, you represent that you meet these requirements.
Acceptable use
You agree not to: (a) scrape, harvest, or systematically extract data from the Site by automated means; (b) misrepresent your identity or submit false contact information; (c) use the Site to transmit unlawful, harassing, or fraudulent content; (d) attempt to interfere with the Site's normal operation or security; or (e) use market data, guides, or tools on the Site to compete with or resell as your own commercial product.
04 · MLS & Listing Data
Property listing information displayed on the Site may be sourced in whole or in part from one or more Multiple Listing Services (MLS) covering Northwest Arkansas. This data is believed to be reliable but is not guaranteed and is provided “as is.” Listing details — including price, status, square footage, and availability — may contain errors, may be outdated, or may change or be withdrawn without notice. Always verify listing details independently and confirm current availability with a licensed agent before making any decision.
Collier & Associates and NWA Stats are committed to the letter and spirit of U.S. policy for the achievement of equal housing opportunity throughout the nation. 05 · No Brokerage Relationship & No Professional Advice
Browsing the Site, downloading a guide, or using a calculator or tool on the Site does not, by itself, create a brokerage, agency, or client relationship with Collier & Associates or any affiliated agent. A brokerage relationship is only formed through a separate, signed agreement.
Educational content, guides, market statistics, and tools on the Site (including any mortgage calculator) are provided for general informational purposes only and do not constitute legal, tax, financial, investment, or professional real estate advice. You should consult qualified professionals — an attorney, lender, tax advisor, or licensed agent — before making decisions based on anything found on the Site.
06 · Information You Submit To Us
When you use a form, calculator, or sign-up on the Site, we collect what you choose to provide us.

We do not knowingly collect information from anyone under 18. If you believe a minor has submitted information to us, contact us using the details in Contact Us and we will remove it.
07 · How We Use Your Information
- Respond to your inquiry To answer your question, provide the guide, report, or listing information you requested, and follow up on a property or service you asked about.
- Provide ongoing service To send market updates, listing alerts, or related communications if you've opted in to receive them.
- Improve the Site To understand which pages and tools are useful, using aggregated, non- identifying analytics.
- Meet legal & brokerage obligations To keep records required by Arkansas real estate law or respond to a lawful request.
We do not sell the personal information you submit through the Site. We do not share it with third parties or affiliates for their own independent marketing purposes. It may be shared with service providers who help us operate the Site or deliver the service you requested (for example, a transaction management or texting platform), bound by obligations to protect it, or where required by law.
08 · Text Messaging (SMS) Terms
This section applies if you provide your mobile phone number through a form on the Site and opt in to receive text messages.
Consent
By submitting your mobile phone number through a form on the Site and checking the applicable consent box, you agree to receive text messages from NWA Stats / Collier & Associates related to your inquiry, requested property information, appointment reminders, and related real estate services. This consent is specific to NWA Stats / Collier & Associates and the purpose for which it was given — it is not shared with unrelated third parties or lead-generation networks for their own outreach.
Message frequency & cost
Message frequency varies based on your inquiry and any follow-up you request. Message and data rates may apply. Rates depend on your mobile carrier and plan.
Opt-out & help
You can opt out of text messages at any time by replying STOP to any message you receive from us. You will receive one final message confirming your opt-out. Reply HELP to any message for assistance, or contact us using the details in Contact Us.
Carriers
Wireless carriers are not liable for delayed or undelivered messages. Text messaging is not available on all carriers or devices.
We do not share, sell, or provide your mobile phone number or SMS opt-in/consent data to third parties or affiliates for their marketing or promotional purposes.

09 · Cookies & Analytics
The Site may use cookies and similar technologies (such as Google Analytics) to understand how visitors use the Site and to improve it over time. This information is generally aggregated and does not identify you personally. Most browsers let you block or delete cookies through their settings; doing so may affect how some parts of the Site function.
10 · Third-Party Links & Tools
The Site links to third-party resources — county GIS and parcel maps, utility providers, mortgage calculators, MLS-powered search tools, and similar sites — for your convenience. We don't control these third-party sites and aren't responsible for their content, accuracy, or privacy practices. Review their own terms and privacy policies before using them.
11 · Intellectual Property
The design, text, guides, graphics, and other original content on the Site are owned by or licensed to NWA Stats / Collier & Associates and are protected by copyright and other laws. You may view and share Site content for personal, non-commercial use; you may not reproduce, redistribute, or create derivative works from it for commercial purposes without our written permission.
The REALTOR® and Multiple Listing Service® marks displayed on the Site are trademarks of the National Association of REALTORS® and are used to indicate active membership and MLS participation; their use does not imply endorsement of any particular listing, product, or service beyond that membership.
12 · Fair Housing Statement
It is illegal to discriminate against any person because of race, color, religion, sex, handicap, familial status, or national origin in the sale, rental, or financing of housing, or in the provision of real estate brokerage services. Collier & Associates and NWA Stats fully support this principle and comply with the Fair Housing Act and all applicable Arkansas fair housing law.
13 · Disclaimers & Limitation of Liability
The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, completeness, merchantability, or fitness for a particular purpose. We do not warrant that the Site will be uninterrupted, secure, or error-free.
To the fullest extent permitted by law, Collier & Associates, NWA Stats, and their agents will not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Site, or from any decision made in reliance on Site content, even if advised of the possibility of such damages.
14 · Indemnification
You agree to indemnify and hold harmless Collier & Associates, NWA Stats, and their agents and employees from any claim or demand, including reasonable attorneys' fees, arising out of your misuse of the Site or your violation of these Terms.
15 · Changes to These Terms
We may revise these Terms periodically to reflect changes in our practices, the Site, or applicable law — including telecommunications and messaging regulations. The “Last updated” date at the top of this page reflects the most recent revision. Material changes to how we handle text messaging or personal information will be reflected here; we encourage you to check back periodically.
16 · Governing Law
These Terms are governed by the laws of the State of Arkansas, without regard to its conflict-of- laws principles. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state or federal courts located in Washington County, Arkansas.
