This policy explains what information we collect through nwastats.com, why we collect it, how it's used and shared, and the choices you have — including around text messages. It's a companion to our Terms & Conditions.

This Privacy Policy applies to nwastats.com (the “Site”) and describes how we collect, use, share, and protect information when you browse the Site, use a tool or calculator, submit a form, or opt in to receive text messages from us. It works alongside our Terms & Conditions, which govern your use of the Site generally.

By using the Site or submitting information through it, you agree to the practices described here. If you don't agree, please don't submit your information to us.

02 · Who We Are

NWA Stats is a real estate information brand serving Benton, Washington, and Madison Counties, Arkansas, operated in connection with Collier & Associates, a licensed Arkansas real estate brokerage located at 2909 Glory Drive, Suite 201, Fayetteville, AR, phone 479.274.0662. We are the “data controller” for information collected through the Site — the party responsible for deciding how it's used.

03 · Information We Collect

Information you give us

  • Contact & inquiry forms Name, email address, phone number, and the content of your message.
  • Buyer, seller, or investor lead forms The above, plus property preferences, price range, timeline, and areas of interest.
  • Newsletter or market-update sign-up Name and email address.
  • Tools & calculators Figures you enter (for example, into the mortgage calculator) to produce a result. These are used only to display that result unless you separately submit a contact form.
  • Phone number for text messaging Collected only when you provide it and opt in — see Text Messaging.

Information collected automatically

Like most websites, we automatically receive some technical information when you visit — your general location (from IP address), browser and device type, pages viewed, and referring page — through cookies and analytics tools. See Cookies & Tracking.

05 · Text Messaging (SMS)

This section applies if you provide your mobile phone number through a form on the Site and opt in to receive text messages.

Consent & use

When you submit your mobile phone number through a form and check the applicable consent box, we use it to send text messages related to your inquiry, requested property information, appointment reminders, and related real estate services from NWA Stats / Collier & Associates. This consent is specific to us and the purpose for which it was given.

Frequency, cost & opt-out

Message frequency varies based on your inquiry. Message and data rates may apply. Reply STOP at any time to opt out — you'll get one confirmation message and no further texts. Reply HELP for assistance, or use the details in Contact Us.

No Data Sharing For Marketing

We do not share, sell, or provide your mobile phone number or SMS opt-in/consent data to third parties or affiliates for their marketing or promotional purposes. Wireless carriers are not liable for delayed or undelivered messages.

Consent to receive text messages is never a condition of purchasing any property or service.

06 · Cookies & Tracking Technologies

We use cookies and similar technologies (such as Google Analytics) to understand how the Site is used and to keep it working properly. These generally collect aggregated, non-identifying information such as pages visited and time on Site. Most browsers let you block or delete cookies in their settings; some parts of the Site may not work as well if you do.

If your browser sends a Global Privacy Control or similar opt-out signal, we make a good-faith effort to honor it for the data uses that signal covers.

07 · How We Share Information

We do not sell your information

We don't sell the personal information you submit through the Site, and we don't share it with third parties or affiliates for their own independent marketing purposes.

We may share information with:

  • Service providers Vendors who help us operate the Site or deliver a service you requested — for example, a texting/CRM platform or web hosting provider — bound by obligations to protect your information and use it only for that purpose.
  • Collier & Associates agents Internally, as needed to respond to your inquiry or provide requested brokerage services.
  • Legal & safety reasons If required by law, subpoena, or to protect the rights, property, or safety of NWA Stats, our users, or others.
  • Business transfers In connection with a merger, acquisition, or sale of business assets, subject to this policy or its successor.

08 · Data Retention

We keep the information you submit for as long as reasonably necessary to respond to your inquiry, provide requested services, maintain brokerage records as required by Arkansas real estate law, and meet other legal or accounting obligations. When information is no longer needed for these purposes, we take reasonable steps to delete or de-identify it.

09 · Data Security

We use reasonable administrative and technical safeguards designed to protect the information you submit. No method of transmission or storage is completely secure, however, and we can't guarantee absolute security.

10 · Children's & Teens' Privacy

The Site is not directed at children, and we do not knowingly collect personal information from anyone under 13. Arkansas's Children and Teens' Online Privacy Protection Act, effective July 1, 2026, also restricts using personal information from Arkansas residents ages 13–16 for targeted advertising; we do not knowingly do this. If you believe a child or teen has submitted information to us, contact us using the details in Contact Us and we will remove it.

11 · Your Choices & Rights

  • Opt out of texts Reply STOP to any message, any time.
  • Opt out of email updates Use the unsubscribe link in any marketing email, or contact us directly.
  • Access, correct, or delete your information Contact us using the details below. Regardless of which specific law applies to your request, we're glad to honor reasonable requests to see, correct, or delete the personal information you've submitted to us.

We will take reasonable steps to verify your identity before acting on a request involving your personal information.

12 · State Privacy Law Notice

Depending on where you live, you may have additional rights under state privacy laws — California's CCPA/CPRA and comparable laws now in place in a growing number of other states typically give residents the right to know what's collected about them, request deletion, and opt out of the sale of personal information. We don't sell personal information, and we aim to honor these rights for anyone who asks, regardless of which specific law technically applies to a visitor or to our business.

Arkansas's own privacy-law landscape is evolving. The Arkansas Children and Teens' Online Privacy Protection Act referenced above takes effect July 1, 2026; separate legislative activity around broader consumer data-privacy rights in Arkansas is ongoing and its current scope is genuinely unsettled as of this writing. See the notice at the top of this page — confirm current applicability with an attorney rather than relying on this paragraph alone.

13 · Third-Party Links

The Site links to third-party resources — county GIS and parcel maps, utility providers, mortgage calculators, MLS-powered search tools, and similar sites — for your convenience. Their privacy practices are their own; review their policies before sharing information with them.

14 · Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, the Site, or applicable law. The “Last updated” date at the top of this page reflects the most recent revision. Material changes — particularly to text messaging or data-sharing practices — will be reflected here; check back periodically.
